This Application (Website, Mobile application, SmartRecruiter’s platform) collects some Personal Data from its Users (Website Visitors or Customer’s Candidates).
Dear SmartRecruiters’ Customer’s candidates, this Privacy Notice specifies the conditions under which SmartRecruiters processes the personal data (any information that directly or indirectly identifies you) of Customer’s candidates, on their behalf, and the terms and conditions for exercising your rights over such data in accordance with the applicable regulations.

Types of Data collected
SmartRecruiters only collects personal data that is necessary for our activities and more particularly to enable our customers to maintain their recruitment process.
SmartRecruiters only collects personal data that is necessary for our activities. As a Customer’s Candidate, we may collect different types of data directly from you or through third parties such as:
- Identification data (data relating to your identity such as your name, mailing address, photos, etc.);
- Contact information (data relating to your contact details such as email address, telephone number, etc.);
- Information relating to your personal and professional situation (such as your CV, professional situation, education, etc.);
- Data collected during our exchanges and interactions (such as chatbot conversations, etc.);
- Browsing data collected via implemented cookies in accordance with the Cookie Policy and connection data related to the use of our services (such as Google Advertiser ID or IDFA, device information, the UUID, crash data, etc.);
- Other types of data (such as your candidate ranking, your answers to the screening questions asked by hiring companies “Our Customers”, etc.) may also be processed based on the Smart Recruiter’s services used by our customers.
Complete details on each type of Personal Data collected are provided in the dedicated section of this Privacy Notice or by specific explanation statements displayed prior to the Data collection. Also depending on your place of residence, you can obtain more information on the data processing carried out in our dedicated sections.
Personal Data may be freely provided by the Customer’s Candidates, or in accordance with our Cookie Policy, collected automatically when using SmartRecruiters services.
Unless specified otherwise, all Data through the use of the Application is mandatory and failure to provide this Data may make it impossible for SmartRecruiters to provide its services. In cases where the Application specifically states that some Data is not mandatory, Customer Candidates are free not to communicate this Data without consequences to the availability or the functioning of the Service.
To obtain further detailed information on the data processing that may be carried out for all the Users, depending on their status, Candidates are welcome to consult our dedicated section or to contact the Owner. Any use of Cookies – or of other tracking tools — by SmartRecruiters or by the owners of third-party services used on the SmartRecruiter’s website, are explicitly described in our Cookie Policy.
The purposes of processing
The Data concerning the Customer’s Candidates is collected to:
To fulfill our contractual obligations: Candidate data may be collected by SmartRecruiters to provide its service and, more specifically, to fulfill its contractual obligations to its customers (hiring companies) who have engaged in a recruitment process with some of the Users.
To ensure the proper functioning of the website of SmartRecruiters: Customer’s Candidate’s Data may be collected to ensure the good functioning of the website and to authenticate your access to various areas of our websites, and tailor its content to your preferences.
Satisfy the legitimate interest of SmartRecruiters: User’s Data data may be collected for various purposes such as advertising, traffic optimization and distribution, analytics, user database management, collection of privacy remarketing and behavioral targeting, managing contacts and sending messages, tag management, heat mapping and session recording, access to third party accounts, infrastructure monitoring and content performance and features testing (A/B testing).

SMS Terms of Service
- Upon opting in to the SmartMessage service, SmartRecruiters will send a confirmation message to the registered mobile number. Consent may be provided at the time of job application by supplying a phone number on the application form, or by following the consent link sent via email when a Candidate is added to the system by a recruiter or via API. By opting in, the User consents to receive informational text messages from the hiring organisation powered by SmartRecruiters, including interview scheduling invitations, reminders, application status updates, and outcomes. Consent is not a condition of purchase. Message and data rates may apply. Message frequency will vary. Text “HELP” for help. Text “STOP” to cancel.
- You can cancel this service at any time. Just text “STOP” to opt out. After you send the message “STOP” to us, we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive messages from us.
- If you want to join again, just text “START” and we will resume sending messages to you.
- If at any time you forget what keywords are supported, just text “HELP”. After you send the message “HELP” to us, we will respond with instructions on how to use our service as well as how to unsubscribe.
- Carriers are not liable for delayed or undelivered messages.

- We do not share consumer opt-in consent with any 3rd parties. Mobile data consent will not be shared with any 3rd parties through this SMS channel.
Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

Means of collection and data recipients
You may directly provide your personal information when you submit requests via any collection forms on SmartRecruiter’s website. Some Data may also be collected indirectly while you are browsing our website through trackers under the conditions defined in the Cookie Policy available on our website.
Depending on the function, and if you give your express consent, data is passed on to up to 52 third parties and processed by them. This consent is voluntary, not required for the use of our website and can be revoked at any time using the icon on the bottom left.
Data retention periods
Unless specified otherwise in this document, Personal Data shall be processed and stored for as long as required by the purpose they have been collected for and may be retained for longer due to applicable legal obligation or based on the Users’ consent.
Therefore:
Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner.
The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to fulfil a legal obligation or upon order of an authority.
Once the retention period expires, Personal Data shall be deleted. Therefore, the right of access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.
The rights of Users
Under applicable regulations, users may exercise certain rights regarding their Data processed by the Owner.
In particular, Users have the right to do the following, to the extent permitted by law:
Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data;
Object to processing of their Data. Users have the right to object to the processing of their Data if the processing is carried out on a legal basis other than consent;
Access their Data. Users have the right to learn if Data is being processed by the Owner, obtain disclosure regarding certain aspects of the processing and obtain a copy of the Data undergoing processing;
Verify and seek rectification. Users have the right to verify the accuracy of their Data and ask for it to be updated or corrected through your profile by going to the “My SmartProfile” Section:
Restrict the processing of their Data. Users have the right to restrict the processing of their Data. In this case, the Owner will not process their Data for any purpose other than storing it;
Have their Personal Data deleted or otherwise removed. Users have the right to obtain the erasure of their Data from the Owner (as you can withdraw and delete your profile at each company you applied for:
Receive their Data and have it transferred to another controller. Users have the right to receive their Data in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance;
Lodge a complaint. Users have the right to bring a claim before their competent data protection authority.

BfDI (GERMANY – BERLIN): To lodge a complaint with a German Data Protection Authority, you must contact the relevant state-level data protection authority for Berlin (Landesdatenschutzbehörde). More information on https://www.bfdi.bund.de.

CPPA (CALIFORNIA): To lodge a complaint regarding the California Consumer Privacy Act (CCPA), you should contact the California Attorney General’s office or the California Privacy Protection Agency (CPPA), through using an online form available at: https://cppa.ca.gov/webapplications/complaint.
Users are also entitled to learn about the legal basis for Data transfers abroad, including to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by the Owner to safeguard their Data.
Any requests to exercise User rights should be directed to the Owner through the contact details they have provided to you. You also can contact SmartRecruiters using the contact details provided in this Privacy Notice. SmartRecruiters will forward your request to the Owner as soon as possible.
Such requests are free of charge and will be answered by the Owner as early as possible and always within one month, providing Users with the information required by law. Any rectification or erasure of Personal Data or restriction of processing will be communicated by the Owner to each recipient, if any, to whom the Personal Data has been disclosed unless this proves impossible or involves disproportionate effort. At the Users’ request, the Owner will inform them about those recipients.
